The Declaration, known as UNDRIP, was adopted on 13 September 2007 by 144 votes to four, with eleven abstentions.
Convention 169, adopted in 1989, is a treaty. It binds only the states that have ratified it, about two dozen so far.
Prior means the people are asked in advance, with enough time to consider, and not after licences have been granted.
The Court held that native title survived colonisation and rejected terra nullius. The case was brought by Eddie Mabo and other Meriam people.
